Implementation of Resolution Conf 8.9

Recommendations of the Standing Committee

1. The present Notification replaces Notification to the Parties No. 1999/06

2. In Notification to the Parties No. 1999/06 of 29 January 1999, the Secretariat informed the Parties of the States that had not implemented recommendations of the Animals Committee made in accordance with Resolution Conf. 8.9 and with respect to which the Standing Committee recommended that all Parties suspend imports of specimens of a particular species.

3. At its 41st meeting, the Standing Committee considered favourably the request from Indonesia to permit, on certain conditions, the export of 102,285 skins of Ptyas mucosus , acquired before Committee's recommendation to suspend imports entered into effect.

4. The Standing Committee also agreed to delete Latvia from the list under paragraph 6 below, because the Secretariat was satisfied that it now had complied with the primary recommendations of the Animals Committee regarding trade in Lynx lynx .

5. On 29 September 1997, the Secretariat communicated to all range States of Strombus gigas the primary recommendations of the Animals Committee. Most of the range States provided satisfactory responses. However, five range States did not respond at all. Consequently, at its 41st meeting the Standing Committee agreed to recommend that Parties not accept imports of specimens of the species in question from Antigua and Barbuda, Barbados, Dominica, Saint Lucia and Trinidad and Tobago.

6. The Standing Committee recommends that all Parties suspend imports of specimens of the species indicated from each State listed below until the Committee is satisfied that appropriate action has been taken to dispel the concerns raised by the Animals Committee.

Lama guanicoe [On the condition that all permits are confirmed by the Secretariat before being accepted by the country of import, the suspension does not apply to:

 

 

a) specimens that form part of the registered stock in Argentina (SC29, March 1993);

 

 

b) products obtained from the shearing of live animals carried out under the approved management programme, appropriately marked and registered; and

 

 

c) non-commercial exports of limited quantities of wool for industrial testing, up to 500 kg annually.]

Ptyas mucosus (SC 41, February 1999) (the suspension does not apply to 102,285 marked skins acquired before the current trade prohibition entered into force on the following conditions:

 

 

a) The export of the skins should not be permitted unless the Secretariat confirms receipt of a copy of the export permit concerned issued by the Management Authority of Indonesia;

 

 

b) Import of specimens from this registered stockpile should be permitted only after confirmation of the validity of the Indonesian export permit by the Secretariat.

[This suspension does not apply to specimens of the last three species produced from ranching/captive-breeding operations, for which the level of annual export quotas has to be agreed between the Management Authority and the Secretariat.]

 

7. The Standing Committee made these recommendations because it considered that the provisions of Article IV, paragraphs 2(a) and 3, were not being adequately implemented by the countries concerned for the species mentioned.

8. The Secretariat will notify the Parties when the Standing Committee withdraws its recommendations regarding any of the above States and species.
